GALSTAYS TERMS AND CONDITIONS FOR TOURISM OPERATORS

AGREEMENT

Between

GALSTAYS “(GALSTAYS”)

And

(“You”)

BACKGROUND

GALSTAYS is a web site which lists strictly gay and lesbian owned and operated tourism businesses. The consumer makes a choice of property, enters some basic information and an e-mail is sent directly to You. The transaction is then between consumer and You.

IT IS AGREED

1. Referral
   
   GALSTAYS will list your accommodation information on its galstays.com.au web site “GALSTAYS web site”) and promote direct contact with you by the consumer “the Referral”).
   
   You agree to provide GALSTAYS with current information for the GALSTAYS web site and you agree to respond to the Referral within 24 hours of its receipt.

2. Copyright
   
   The information contained within GALSTAYS website is under copyright. Should you wish to use any of the information please contact info@galstays.com.au

3. Third Party Copyright
   
   Please be aware galstays.com.au has material on its website by permission that is copyright by a third party. Should you wish to use any of the information please contact us on info@galstays.com.au

4. Links
   
   All external links are provided to assist the gay and lesbian traveller. GALSTAYS does not endorse the views or content on any linked sites.

5. Privacy Policy
   
   GALSTAYS treats any personal information provided by You with discretion and in accordance with current privacy laws. You agree not to use a guest’s information to contact them except for the sole purpose of answering a particular request from GALSTAYS.

6. Fees
   
   You agree to pay GALSTAYS $10 for each night of each booking made as a direct result from a GALSTAYS Referral. Should the nightly rate be less than $100 then you agree to pay 10% of the rate. Should you be a tourism operator offering anything other than accommodation then you agree to pay 10% of the rate charged to the consumer.
   

1. At the end of each calendar month, we will send you a list of the enquires made via galstays.com.au
2. Please correct this list to reflect all bookings, we understand not all enquiries turn into bookings.

PLEASE NOTE: We trust the vast majority of tourism operators will report bookings accurately and will agree to pay a nominal fee of $10 booking per night or 10% as detailed above. We do survey visitors to get feedback on quality and whether the stay actually happened.

7. GALSTAYS obligations to You
   

1. GALSTAYS agrees to list properties on its web site that are owned and operated by gays and lesbians;and
2. Agrees to promote and advertise the site within the gay and lesbian media and at gay and lesbian events.

Galstays maintains the right to amend update or alter any information which appears on its web site.

8. Limitation of Liability
   
   GALSTAYS accepts not liability for any cancellation or amendment of any booking made as a result of a Referral.
   
   GALSTAYS accepts no liability for any act or omission by any consumer in relation to You or your property.
   
   GALSTAYS is not your agent nor your employee and accepts no liability for any act or omission by any of your agents or employees.
   
   GALSTAYS accepts no liability for any inaccurate information placed on the GALSTAYS web site by you and does not warrant the accuracy of any information on the GALSTAYS web site.

9. Website Use
   
   By listing your site on galstays.com.au you accept these terms and conditions and agree not to use the GALSTAYS website for any unlawful or prohibited activities, either as stipulated in these Terms & Conditions or governed by other applicable laws and regulations.
   
   Your on-going use of the GALSTAYS website indicates that you indemnify GALSTAYS from any damage, loss or costs in connection with any breach of these conditions, or any other legal obligation by you and your use of GALSTAYS website.

9. Travel Agents

You agree that should a booking be made by a Travel Agent on behalf of a consumer who has been introduced to you by Referral , you remain obliged to pay GALSTAYS $10 for each night of each booking.

10. Removal of Listings

GALSTAYS reserves the right to remove any listings or information from its website without specifying a reason.

11. Insurance

You warrant that You and your property are insured and licensed to accommodate guests and You and your property meet all applicable requirements, rules and regulations with local authorities where the property is located.
